Pistorius appeal set for December

Pretoria - The application for leave to appeal both the conviction and sentence for Paralympian Oscar Pistorius will be heard at the North Gauteng High Court on December 9, the National Prosecuting Authority (NPA) announced on Monday. 

The NPA further confirmed receipt of a notice, from Pistorius' defence, to the effect that they will be opposing the application by the state.

According to the NPA, the decision to appeal was taken on the basis that it believes reasonable prospects of a successful appeal based on a question of law exists.

“In addition, the NPA is of the view that it is of critical importance to seek clarity, from the Supreme Court of Appeal, on the principle of Dolus Eventualis,” read the statement. - SAnews.gov.za
