Pretoria - The Johannesburg Labour Court on Sunday ruled that Crime Intelligence head, Lieutenant General Richard Mdluli, should remain on suspension.
"Today at 10am, the court ruled that he [Mdluli] remain on suspension. The order that was issued on Friday that he should be re-instated is now set aside," South African Police Services (SAPS) spokesperson Brigadier Lindela Mashigo told BuaNews.
This comes after lawyers for the police brought an urgent application to the court on Saturday, seeking to aside the lifting of Mdluli's suspension.
Mdluli was on Friday granted an order lifting his suspension. Friday's ruling ordered that Mdluli return immediately to work.
Additionally, Friday's order was obtained in the absence of the SA Police Service and without the SAPS' knowledge.
According to the directions that were given to the court, the urgent application brought by Mdluli was scheduled to be heard on Monday.
The police said the circumstances under which Mdluli obtained the order were "extremely worrisome".
"SAPS is currently investigating how the court could conceivably have granted the order in favour of General Mdluli and in the absence of the SAPS, whilst the same court made a directive that the urgent application would be heard on Monday," said SAPS in a statement on Saturday.
Mdluli was suspended for a second time last Sunday by acting National Police Commissioner, Lieutenant-General Nhlanhla Mkhwanazi. The suspension was in response to the serious allegations that had emerged from an inquest.
"The court indicated that all costs should be paid by Mdluli," added Mashigo.
