Minister 'still studying' Public Protector report

Pretoria - The Public Works Department says Minister Gwen Mahlangu-Nkabinde has received the Public Protector's report and is still studying it.

"The minister acknowledges receipt of the report ... and will comment and respond to questions from the media after briefing Cabinet," said the department on Saturday.

The report looks into complaints and allegations of improper and unlawful conduct relating to the leasing of office accommodation in Pretoria for the South African Police Service headquarters.

The controversial lease agreement was signed by the department, and not by National Police Commissioner Bheki Cele as initially alleged.

The Public Protector has rendered the lease invalid, saying it was riddled with impropriety and unlawful conduct, which did not observe the stipulations set out in the Public Finance Management Act.

Cele has meanwhile come out fighting against those calling for his resignation, saying he has not been found guilty of any wrong doing by a court of law.

He has also disputed Public Protector Thuli Madonsela's findings that he was involved in improper, unlawful conduct, which amounted to maladministration, with regards to the procurement process of the lease agreement for police headquarters.

Cele said this was a "factual and legal difference" with Madonsela and that he was being "advised on the matter."

In her report last week, Madonsela rendered the R500 million lease invalid. She said the process that led to the conclusion by the Department of Public Works of the lease agreement with Roux Property Fund was flawed in various respects.

These flaws include non-compliance with prescribed procurement procedures, such as ensuring a competitive bidding process.
